Injured at work - let me help you get what you’re entitled to
Your job is not only your livelihood, it’s also a big part of who you are. The ability to work is something we often take for granted. When that ability is taken away, it can be both financially and psychologically devastating. Navigating the Return to Work system can be confusing, overwhelming and stressful - let me assist you.
Claim for Workers Compensation
If you have sustained a psychological or physical injury at work, you may be entitled to support, treatment and compensation from Return to Work. I can assist in providing advice about your next steps, entitlements and making a claim.
Accepted Claims
If you have an accepted claim and just want to ensure you are receiving all your entitlements, have questions, need assistance in making a claim or just want some advice - book into the free clinic service!
Rejected Claims
There are many scenarios in which you may have a rejected claim -
your initial claim may be rejected for a multitude of reasons (injury isn’t work related, there was disciplinary / administrative action taken, you had a pre-existing condition, and the list goes on!);
your claim for services, aids, treatment and/or surgery has been rejected;
refusal for an injury to be assessed for lump sum compensation.
Review of a Decision (Dispute)
It may be possible to seek a review of the decision that has resulted in a rejected claim. There are other scenarios in which you may seek a review including your income being calculated incorrectly, modified duties (or lack of duties) being provided to you by your employer, employment terminated by your employer or your claim being discontinued. If it feels unfair - talk to me!
There is a timeframe of 28 days from the date of the decision / rejection in which you can seek a review or dispute the decision in the South Australian Employment Tribunal. If it is outside of this timeframe, you should contact me immediately for advice as there may still be opportunity to dispute / seek a review.
Lump Sum Compensation
If you have sustained an injury and work is a significant contributing cause (whether a primary injury or consequential injury), you are entitled to undergo an assessment of your whole person impairment and may be eligible for lump sum compensation. I can assist you in pursuing these entitlements either on your behalf or by giving you the advice to pursue it yourself.
I have a passion for helping people, and I’ll help you to get back feeling like you again, as well as fighting for what you are entitled for.
We have a ‘no win, no fee’ policy, no client / solicitor fee and fixed pricing depending on the type of assistance you require.
Book an appointment so I can help you work through what to do next.
COSTS
New Claim or Accepted Claim - book into the free legal advice service.
Rejected Claim - if your matter is reviewed (disputed) in the South Australian Employment Tribunal you are entitled to an award of costs against the relevant compensating authority. What this means is that Return to Work will pay a prescribed amount towards legal costs. I do not charge above what is recoverable from Return to Work so you will not incur legal fees.
Whole Person Impairment Assessment (Lump Sum Compensation) - I understand the prospect of incurring legal fees can be stressful so I charge a fixed fee so you know exactly what your fees will be before we begin working together.
I also work on a ‘no win, no fee’ basis - if you do not receive a lump sum, you will not be charged legal fees.
